This panel will examine the evolving duty of good faith in insolvency proceedings, highlighting how recent statutory reforms and Supreme Court decisions have potentially shifted the focus from subjective intentions to more objective standards of honesty, candor, and reasonableness. Panelists will discuss how these changes impact all stakeholders, including debtors, creditors, trustees, monitors, and bidders. They will also explore practical challenges in identifying and remedying bad faith conduct, the boundaries of permissible self-interest, and the implications for voting rights and asset sales.
